Version: 21 October 2026

Intended effective date: 1 November 2026

1. General provisions

1.1. These SMARTFIT Rules on Exercising the Right of Withdrawal (the “Withdrawal Rules”) govern how Consumers exercise their statutory right to withdraw from a distance Contract, including the return of Goods, return shipping costs, diminished value, refunds and other related matters.

1.2. The seller of Goods and operator of SMARTFIT online stores is:

SIA SmartFit Performance
Registration No. 40203767418
VAT registration No. LV40203767418
Registered address: Ģimnāzijas iela 34/36 – 20, Daugavpils, LV-5401, Latvia
Email: SMARTFIT email address

hereinafter referred to as the Seller or SMARTFIT.

1.3. These Withdrawal Rules apply to online stores and domains operated by SMARTFIT, including:

www.smartfit.lv;

  • language, country and regional versions of these Websites

other SMARTFIT domains or subdomains operated by SIA SmartFit Performance on which these Withdrawal Rules are published,

hereinafter collectively referred to as the Website or SMARTFIT Websites.

1.4. If a different legal entity acts as Seller in a particular transaction on a SMARTFIT domain, the rules published on that entity’s Website apply to that transaction.

1.5. These Withdrawal Rules form an integral part of the SMARTFIT Terms of Use and Distance Purchase in matters concerning Consumers’ withdrawal rights.

1.6. The SMARTFIT Delivery Terms also apply to delivery, receipt and transport of shipments.

1.7. The SMARTFIT Warranty, Non-conformity, Service and Repair Terms apply to product defects, non-conformity with the Contract, commercial warranties, diagnostics, servicing and repairs.

1.8. The terms Consumer, Buyer, B2B Buyer, Goods, Order, Contract, Delivery Service Provider and other defined terms have the same meanings as in the SMARTFIT Terms of Use and Distance Purchase unless stated otherwise here.

1.9. If these Withdrawal Rules conflict with the SMARTFIT Terms of Use and Distance Purchase on a matter concerning withdrawal rights, these Withdrawal Rules prevail on that matter as the specific provisions.

1.10. SMARTFIT provides Consumers with the statutory model withdrawal form, available via the link in Section 6 of these Withdrawal Rules.

1.11. Use of the SMARTFIT withdrawal form is optional. A Consumer may also withdraw by making any other unequivocal statement of their decision to withdraw from the Contract.

1.12. Nothing in these Withdrawal Rules limits any mandatory rights granted to Consumers under applicable law.

2. Who has the right of withdrawal

2.1. The statutory right to withdraw from a distance Contract is available to Consumers.

2.2. A Consumer is a natural person purchasing Goods or services for purposes unrelated to their trade, business or profession.

2.3. Buyer status is determined by the actual purpose of the transaction and applicable law, not solely by the details shown in the Order or invoice.

2.4. The statutory 14-day withdrawal right granted to Consumers does not apply to B2B Buyers.

2.5. Returns of conforming Goods by B2B Buyers are governed by the SMARTFIT Terms of Use and Distance Purchase and, where applicable, an individual agreement with the Seller.

3. The 14-day right of withdrawal

3.1. Where provided by law, a Consumer may withdraw from a distance Contract within 14 calendar days without giving any reason.

3.2. For a single item, the withdrawal period begins on the day the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Goods.

3.3. If multiple items ordered together are delivered separately, the period begins on receipt of the last item.

3.4. If an item is delivered in several lots or pieces, the period begins on receipt of the last lot or piece.

3.5. For a Contract providing for regular delivery of Goods over a defined period, the withdrawal period begins on receipt of the first item.

3.6. For a service Contract, the withdrawal period begins on the date the Contract is concluded.

4. Collecting an order from a SMARTFIT store

4.1. If a distance Contract is concluded on a SMARTFIT Website, subsequent collection of the Goods from a SMARTFIT store does not in itself remove the withdrawal rights applicable to distance Contracts.

4.2. In that case, the 14-day period begins on the day the Consumer or their designated person actually receives the Goods.

4.3. If the Website was used only to make a non-binding reservation and the purchase Contract is concluded in a physical store after the Buyer has examined the Goods and decided to purchase them, the transaction is not necessarily a distance Contract and the distance-contract withdrawal right may not apply.

5. Extended withdrawal period

5.1. If SMARTFIT has not properly provided the mandatory statutory information about the right of withdrawal, the extended withdrawal period prescribed by law applies.

5.2. Where the required information has not been provided, the withdrawal period may be extended by 12 months after the original period expires.

5.3. If SMARTFIT provides the required information during that additional period, the withdrawal period expires 14 days after the Consumer receives it.

6. Withdrawal form and notice of withdrawal

6.1. To exercise the right of withdrawal, the Consumer must inform SMARTFIT of their decision to withdraw from the Contract before the withdrawal period expires.

6.2. SMARTFIT provides Consumers with the statutory withdrawal form:

Download the SMARTFIT withdrawal form (PDF)

6.3. Use of the SMARTFIT withdrawal form is optional. The Consumer may also withdraw by any other unequivocal statement clearly communicating the decision to withdraw from the Contract.

6.4. Notice of withdrawal may be submitted:

  • Send the completed SMARTFIT withdrawal form to SMARTFIT email address
  • Send another unequivocal written notice of the decision to withdraw from the Contract to SMARTFIT email address
  • sending written notice by post to the SMARTFIT address
  • submitting written notice at a SMARTFIT retail location
  • using another withdrawal notification method expressly offered by SMARTFIT

6.5. The notice of withdrawal should preferably include:

  • the Consumer’s full name
  • the Order or invoice number, if known
  • the Goods to which the withdrawal relates
  • the Order date and/or date of receipt of the Goods
  • contact details, where necessary to identify the Consumer or Order

6.6. Attaching a copy of proof of purchase is not a mandatory condition for exercising withdrawal rights if the transaction can be identified otherwise.

6.7. When the SMARTFIT withdrawal form is submitted electronically, a handwritten signature is not required. The signature field is intended for forms submitted on paper.

6.8. An RMA number, service request, prior authorisation from the Seller or any other additional procedure is not a prerequisite for exercising statutory withdrawal rights.

6.9. The Consumer must be able to prove that the withdrawal notice was sent within the prescribed period. SMARTFIT therefore recommends retaining evidence such as a sent-email confirmation or postal receipt.

7. Withdrawal before receiving goods

7.1. A Consumer may notify SMARTFIT of the decision to withdraw from a distance Contract even before physically receiving the Goods.

7.2. If the Order has not yet been handed to the Delivery Service Provider, SMARTFIT will attempt to stop dispatch where reasonably possible.

7.3. If the parcel has already been handed to the Delivery Service Provider, SMARTFIT and the Consumer will agree on a practical return arrangement.

7.4. An unequivocal notice of withdrawal is not the same as simply failing to collect a parcel.

8. Failure to collect a parcel is not notice of withdrawal

8.1. The following actions, by themselves:

  • not collecting a parcel from a parcel locker
  • not collecting a parcel from a collection point
  • not coming to the SMARTFIT store to collect an Order
  • not responding to the courier

simply refusing to accept an undamaged parcel without giving notice of withdrawal

does not, in itself, constitute a notice of withdrawal.

8.2. A Consumer wishing to exercise the right of withdrawal must send SMARTFIT an unequivocal notice.

8.3. If a parcel is returned to SMARTFIT because the Buyer failed to collect it and the Seller has not received a notice of withdrawal, the SMARTFIT Delivery Terms concerning unsuccessful delivery also apply.

8.4. Refusing a parcel because of visible transit damage, where the reason is documented in accordance with the SMARTFIT Delivery Terms, is not equivalent to simply failing to collect a parcel.

9. Returning goods

9.1. After sending notice of withdrawal, the Consumer must hand over or dispatch the Goods to SMARTFIT without undue delay and no later than 14 calendar days after notifying SMARTFIT of the decision to withdraw from the Contract.

9.2. The deadline is met if the Goods are dispatched before the 14-day period expires.

9.3. Return address:

SIA SmartFit Performance
Ģimnāzijas iela 34/36 – 20, Daugavpils, LV-5401, Latvia

unless SMARTFIT has specified a different return location in writing for the particular return.

9.4. Goods may be returned by:

  • by post or courier
  • by delivering them personally to SMARTFIT
  • by another method agreed with SMARTFIT in advance

9.5. The Goods need not be sent to the manufacturer, supplier, service centre or any other third party unless SMARTFIT specifically instructs otherwise.

9.6. Cash-on-delivery (COD) return parcels may be refused unless SMARTFIT has agreed to them in advance.

9.7. SMARTFIT recommends using a trackable return method and keeping proof of dispatch.

10. Return shipping costs

10.1. When exercising the right of withdrawal, the Consumer bears the direct cost of returning the Goods if SMARTFIT duly informed the Consumer of this obligation before the Contract was concluded.

10.2. If SMARTFIT has agreed to cover the return costs in a particular case, SMARTFIT will bear those costs.

10.3. If the Consumer was not duly informed of the obligation to bear the direct cost of returning the Goods, the consequences prescribed by law apply.

10.4. No separate penalty or administration fee is charged solely for exercising statutory withdrawal rights.

11. Bulky goods and goods that cannot normally be returned by post

11.1. If the Goods cannot normally be returned by post because of their nature, weight or dimensions, the Consumer will receive the statutory pre-contract information about the direct return costs or an estimate of those costs.

11.2. This may be particularly relevant to:

  • bulky Goods
  • heavy Goods
  • palletised shipments

11.3. Consumers are advised to contact SMARTFIT before arranging the return of such Goods.

12. Examining goods during the withdrawal period

12.1. Consumers may inspect and test Goods to the extent necessary to establish their nature, characteristics and functioning.

12.2. In principle, such examination should not exceed what would be possible when examining similar Goods in a physical shop.

12.3. Opening the packaging does not in itself result in loss of withdrawal rights, except where a statutory exception applies to the particular Goods.

12.4. During the withdrawal period, Consumers should handle the Goods with care and avoid actions unnecessary to establish their nature, characteristics and functioning.

13. Use and functional testing of goods

13.1. Consumers may reasonably inspect and functionally test Goods sold by SMARTFIT to the extent necessary to establish their nature, characteristics and functioning.

13.2. Depending on the Goods, the following may exceed the scope of necessary examination:

  • using Goods for commercial or professional purposes beyond the extent necessary for testing
  • prolonged or repeated operation of Goods
  • using Goods in a manner causing significant wear or contamination
  • extended or regular use of Goods
  • repeated use beyond what is necessary for testing
  • using Goods with abrasive materials, liquids or chemicals
  • consuming supplies or consumable components
  • a significant increase in operating hours or cycles
  • creating signs of use that would not arise from ordinary examination and functional testing

13.3. Briefly switching on Goods or conducting reasonable functional testing does not in itself mean that their value has diminished.

13.4. Each case is assessed individually, taking account of the Goods’ nature, characteristics and the objectively necessary extent of testing.

14. Diminished value of goods

14.1. The Consumer is liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

14.2. SMARTFIT does not automatically charge a fixed percentage, restocking fee, administration fee or penalty merely because Goods have been returned.

14.3. Any diminished value is assessed individually and objectively, considering, for example:

  • intensity of use
  • operating hours or cycles
  • wear and tear
  • contamination
  • mechanical or cosmetic damage
  • missing parts
  • used or consumed accessories
  • changes to the supplied contents
  • the actual condition of the Goods
  • the objective market and resale value of the Goods

14.4. SMARTFIT may document the condition of returned Goods by photograph or video.

14.5. If diminished value is identified, SMARTFIT informs the Consumer of the circumstances and the grounds for the assessment.

14.6. Diminished value is taken into account only to the extent and in the manner permitted by applicable law.

14.7. The Consumer is not liable for diminished value where SMARTFIT failed to provide the required statutory information about withdrawal rights, insofar as the law so provides in the particular case.

15. Original packaging

15.1. The absence of original packaging does not automatically extinguish the Consumer’s withdrawal rights.

15.2. The Consumer may open packaging to the extent objectively necessary to examine and test the Goods, unless a statutory exception applies.

15.3. SMARTFIT recommends retaining:

  • original packaging
  • internal protective materials
  • instructions
  • cables
  • adapters
  • accessories
  • other items supplied with the Goods

15.4. If packaging is important for safe transport or the objective commercial value of the Goods, and it has been unnecessarily and substantially damaged or destroyed, this may be considered when assessing diminished value.

16. Contents of the product package

16.1. When returning Goods, the Consumer must return all components supplied with them that are capable of being returned.

  • These may include, for example:
  • the Goods themselves
  • power supply
  • cables
  • handles
  • stands
  • pads
  • accessories
  • reusable components
  • documentation
  • other items included in the package

16.2. A missing component does not automatically extinguish the right of withdrawal, but it may objectively diminish the value of the Goods or set.

17. Refunds

17.1. Where a Consumer lawfully exercises the right of withdrawal, SMARTFIT refunds the amounts required by law without undue delay and no later than 14 days after receiving the Consumer’s notice of withdrawal.

17.2. For a sale of Goods, unless SMARTFIT has offered to collect the Goods itself, SMARTFIT may withhold the refund until:

the returned Goods being received; or

the Consumer providing evidence that the Goods have been sent back,

whichever occurs first, unless applicable law provides otherwise in the particular case.

17.3. The refund is made using the same means of payment as the Consumer used for the original transaction, unless the Consumer expressly agrees otherwise and incurs no additional cost as a result.

17.4. No separate fee is charged to the Consumer for processing the refund.

18. Original delivery costs

18.1. Where the Consumer withdraws from the entire distance Contract, SMARTFIT also refunds the original standard delivery charges to the extent required by law.

18.2. If the Consumer chose a delivery method more expensive than the least expensive standard delivery offered by SMARTFIT, SMARTFIT need not refund the additional cost attributable to that choice.

18.3. In the case of partial withdrawal, whether and to what extent the original delivery charges must be refunded is assessed under applicable law and the circumstances of the Order.

18.4. SMARTFIT does not automatically impose a retrospective delivery charge merely because a partial return reduces the remaining Order value below the free-delivery threshold, unless a different legally permissible condition was clearly specified before the Contract was concluded.

19. Partial withdrawal from an order

19.1. If several independent items were purchased in one Order, the Consumer may exercise withdrawal rights in respect of only some of them.

19.2. If Goods were sold as a single indivisible set for one price and individual components were not separate subjects of the Contract, the possibility of withdrawing in respect of individual components is assessed according to the offer and the structure of the Contract.

20. Promotions, bundles and gifts

20.1. If a free gift was provided with a purchase on the clearly stated condition that it was available only with that purchase, and the Consumer withdraws from the purchase in full, the gift must be returned with the Goods, provided this condition was clearly communicated before the Contract was concluded.

20.2. If the Consumer partially withdraws from an Order and the previously stated promotion or bundle conditions are no longer met, the consequences are assessed under the promotion terms and applicable law.

20.3. SMARTFIT does not automatically charge a penalty for failing to return a gift or for exercising withdrawal rights.

20.4. If an unreturned, used or damaged gift objectively gives rise to legally recoverable diminished value or another claim, SMARTFIT assesses and substantiates it individually.

21. Health and hygiene exception

21.1. The Consumer cannot exercise the right of withdrawal in respect of sealed Goods if:

  • the Goods were supplied in sealed packaging

the Consumer opened that packaging after delivery; and

for health-protection or hygiene reasons, the Goods are objectively unsuitable for return once the packaging has been opened.

21.2. Merely belonging to a particular product category does not in itself mean that withdrawal rights are excluded.

21.3. The hygiene exception is assessed according to the nature of the specific Goods, their packaging and whether they can objectively be returned for health-protection or hygiene reasons after the protective seal is broken.

21.4. Where a withdrawal exception applies to particular Goods, SMARTFIT provides the required information before the Contract is concluded.

22. Personalised and custom-made goods

22.1. The right of withdrawal does not apply to Goods made to the Consumer’s specifications or clearly personalised.

22.2. The fact that SMARTFIT specially orders standard Goods from a supplier or manufacturer after receiving the Consumer’s Order does not, by itself, mean those Goods are personalised or made to the Consumer’s specifications.

22.3. Goods may be considered custom-made or personalised where their essential characteristics have been manufactured or materially adapted specifically at the request of that Consumer.

23. Other exceptions to the right of withdrawal

23.1. Withdrawal rights are also excluded in other cases prescribed by law.

23.2. Depending on the specific Goods or services offered by SMARTFIT, these may include, for example:

  • Goods liable to deteriorate or expire rapidly
  • Goods that, after delivery, have become inseparably mixed with other items by their nature
  • sealed computer software, audio or video recordings that have been unsealed, where prescribed by law
  • fully performed services where the statutory conditions for losing the withdrawal right are satisfied
  • urgent repair or maintenance services in certain cases
  • digital content whose supply has begun in compliance with statutory requirements for Consumer consent and information
  • other cases provided by law

23.3. Where withdrawal rights do not apply to particular SMARTFIT Goods or services, the Consumer is informed before the Contract is concluded.

24. Services during the withdrawal period

24.1. If a Consumer orders a paid service at a distance and expressly requests that performance begin before the end of the 14-day withdrawal period, SMARTFIT may begin performance in accordance with applicable law.

24.2. If the Consumer subsequently withdraws after making such a request, the Consumer may, where prescribed by law, have to pay a proportionate amount for the part of the service actually supplied before the notice of withdrawal was received.

24.3. If the service has been fully performed with the Consumer’s prior express consent and the statutory conditions are satisfied, the Consumer may lose the right of withdrawal.

25. Withdrawal rights and non-conforming goods

25.1. The right of withdrawal and remedies for Goods that do not conform to the Contract are two separate legal mechanisms.

25.2. The Consumer need not exercise the 14-day withdrawal right in order to report a defect or non-conformity.

25.3. If Goods are damaged, do not work or otherwise fail to conform to the Contract, the Consumer may exercise the statutory remedies regardless of whether the withdrawal period has expired.

25.4. The SMARTFIT Warranty, Non-conformity, Service and Repair Terms apply in such cases.

25.5. Where a non-conformity claim is justified, costs that the Seller must bear by law are not passed on to the Consumer.

25.6. Damage occurring in transit for which the Consumer is not responsible is not treated as diminished value caused by the Consumer during the withdrawal period.

25.7. The SMARTFIT Delivery Terms also govern the reporting and documentation of transit damage and the retention of evidence.

26. Returns from outside the EU customs territory

26.1. If Goods are returned from a country or territory outside the customs territory of the European Union, the Consumer is advised to contact SMARTFIT before dispatch for information about the necessary return and customs documents.

26.2. Return shipping documents must truthfully describe the nature of the shipment and the reason for its return.

26.3. The Consumer must follow lawful and reasonable instructions necessary to avoid unjustified import taxes, customs duties or other costs for SMARTFIT.

26.4. If the Consumer deliberately provides incorrect information or unreasonably fails to cooperate, resulting in direct and documented additional costs, recovery of those costs may be assessed under applicable law.

27. Packaging goods for return transport

27.1. Goods being returned must be packaged so that they are reasonably protected against damage during return transport.

27.2. SMARTFIT recommends reusing the original transport packaging if it has been retained and is suitable for another shipment.

27.3. Expensive, heavy, fragile and bulky Goods require transport packaging and protective materials appropriate to their weight, size and nature.

27.4. If inadequate packaging causes damage during return transport, this may be considered when assessing diminished value attributable to the Consumer.

28. Product identification and serial numbers

28.1. SMARTFIT may verify the returned Goods’ identifying details, including:

  • serial number
  • model number
  • batch number
  • other product identifier
  • items included in the package

28.2. Under the right of withdrawal, the Consumer must return the same Goods as were received under the relevant Order.

28.3. Returning different Goods, another person’s Goods, Goods with a mismatched serial number or Goods with deliberately altered identifiers does not constitute returning the Goods received under the relevant Order.

28.4. In such a case, SMARTFIT may withhold the relevant purchase-price refund until the Goods actually received under that Order are returned, to the extent permitted by law.

29. Inspection of returned goods

29.1. Upon receipt of returned Goods, SMARTFIT may inspect:

  • identity of the Goods
  • items included in the package
  • external condition
  • visible signs of use
  • contamination
  • functional condition
  • operating hours or cycles, where recorded by the Goods
  • serial numbers
  • other objectively relevant circumstances

29.2. Such inspection in connection with withdrawal rights is not, in itself, a paid diagnostic service charged to the Consumer.

29.3. SMARTFIT may take photographs or videos to document the condition of Goods upon receipt, in compliance with applicable personal-data protection rules.

30. Versions and amendments to these rules

30.1. The version of these Withdrawal Rules applicable to a particular Contract is the version in force when that Contract was concluded.

30.2. SMARTFIT may amend these Withdrawal Rules for Contracts concluded in the future.

30.3. Subsequent amendments do not in themselves change or reduce the Consumer’s rights under an existing Contract.

32. Online withdrawal function

32.1. Where applicable law requires an online withdrawal function for a particular distance Contract, SMARTFIT provides that function through the Website in accordance with the law.

32.2. The withdrawal function is easily accessible and clearly identifiable and enables Consumers to submit a notice of withdrawal.

32.3. SMARTFIT enables Consumers to confirm submission of their withdrawal notice and sends an acknowledgement of receipt on a durable medium without undue delay, including the information required by law.

32.4. Use of the online withdrawal function does not restrict the Consumer’s right to use other legally permitted methods of giving notice of withdrawal.
